1. Introduction
Please read these Terms and Conditions carefully before placing an order with Evo 3D LTD. By placing an order, you agree to be bound by these Terms and Conditions, which form a legally enforceable agreement.

2. Application
These Terms apply to the purchase of goods and services by consumers and businesses. By ordering, you confirm that:
- You are at least 18 years old;
- You have the authority to enter into a binding contract;
- You acknowledge different terms may apply depending on your consumer/business status.

Rapid Fusion LTD is a company included under these Terms and Conditions and is a sister company of Evo 3D LTD, offering complementary services, technical support, and installation solutions. Any references to Evo 3D LTD within this document may also apply to Rapid Fusion LTD where relevant.
4. Definitions
- Customer: An individual acting outside their business, trade, or profession.
- Business: An entity engaged in commercial or professional activity.
- Contract: The legally binding agreement between you and Evo 3D LTD.
- Goods: Products listed and sold on our website.
- Order: A request made by a Customer or Business to purchase Goods.

5. Goods
- Product descriptions are illustrative and may differ slightly in appearance.
- All parts are subject to availability and potential lead times, which will be communicated.
- Substitute parts may be provided if they meet or exceed original specifications.
- Custom orders must be accurately specified.
- Specifications may be updated to comply with legal or safety regulations.
6. Personal Information
- Your personal data is handled in accordance with our Privacy Policy.
- By placing an order, you agree to be contacted via email, phone, or post.
7. Order and Contract
- Website orders are offers, not acceptance.
- A contract is formed when an Order Confirmation is issued.
- Evo 3D LTD may reject orders and will notify accordingly.
- Quotations are valid for 7 days unless withdrawn earlier.
8. Pricing and Payment
- Prices include VAT and are listed at time of order.
Evo 3D LTD Payment Terms:
- Unless otherwise agreed in writing, payment is required in full upfront before any goods or services are dispatched.
Rapid Fusion LTD Payment Terms:
- Payment terms for Rapid Fusion may be agreed upon in writing and are subject to successful credit checks. Standard terms may mirror Evo 3D LTD unless alternative arrangements are made in advance.
- Payment Terms If agreed in writing and subject to credit checks
- 50% upfront
- 25% on delivery
- 25% on commissioning/installation (whichever is agreed)
- Credit terms may be offered upon successful credit check.
- Late payments incur £40 fee + 8% interest above BoE base rate.
- Payment methods include credit/debit card and others shown at checkout.

9. Delivery
- Delivery within 30 days unless otherwise agreed.
- Installation and training may incur additional charges if not otherwise quoted for.
- Should the customer refuse training or installation the warranty will be void should any damage or misuse occur
- Failure to prepare the site may cause delays and extra costs.
- Customer to ensure they have the following prior to delivery include:
- Adequate power supply
- Data connections (if applicable)
- Lifting equipment forklift, and where required fork extensions
- Sufficient access to the site, door widths and access to route to installation location
- Ramps where required
- Risk passes at delivery; ownership transfers on full payment.
- International orders may face customs duties—Customer is responsible.
10. Right to Cancel (B2C only)
- Cancel within 14 days of receiving goods.
- Notify us by email, post, or website form.
- Return within 14 days after cancellation notice.
- Refunds issued within 14 days of returned goods (less damage or handling costs).
10.1 Exclusions

- Goods inseparably mixed after delivery
11. Returns
- Send returns to: Unit 33 De Havilland Road, Dakota Way, Skypark, Exeter, EX5 2FL
- Customers are responsible for return postage and packaging unless otherwise agreed.
- Goods remain your responsibility until received by Evo 3D LTD.
12. Conformity and Guarantee
- Goods must be as described, of satisfactory quality, and fit for purpose.
- Manufacturer warranties apply in addition to your statutory rights.
- Remote installation and support provided unless otherwise arranged.
13. Warranty, Returns & Liability
See our Technical Support page or email helpdesk@evo3d.co.uk. Response time: within 8 business hours, Mon–Fri, 9:00–17:00 (excluding public holidays). Faster response if you have an Enhanced Service Contract.
13.1 For Consumers
- Protected by the Consumer Rights Act 2015.
- 6-month guarantee: free repair/replacement or refund if faulty.
- The consumer will be liable for the delivery cost unless otherwise agreed
- After 6 months, proof of fault at delivery is required.
13.2 For Businesses
- Governed by the Sale of Goods Act 1979.
13.2.1 Implied Terms
- Goods must be:
- Satisfactory quality
- Fit for disclosed purpose
- As described
13.2.2 12-Month Manufacturer’s Warranty
- Covers manufacturing faults (excludes wear-and-tear, misuse, or consumables).
- Certain parts may require a long lead time
- Should the manufacturer cease to operate EVO-3D will not be liable for the manufacturer’s warranty or spares
- Evo 3D LTD is a reseller—not liable beyond manufacturer’s coverage.
- Post-warranty support is chargeable.
- Extended Service Contracts are available separately.
13.2.3 Inspection & Acceptance
- Inspect goods on delivery. Report any damage within 5 working days.
13.3 Returns & Refunds
13.3.1 Consumers
- 14-day cooling-off period for unused items.
- Custom items are non-returnable unless faulty.
13.3.2 Businesses
- Returns are discretionary.
- Up to 20% restocking fee.
- Goods must be in original, unused condition.
13.4 Exclusions
No warranty/returns for:
- Misuse, neglect, or unauthorised modification
- Incorrect setup or power surges
- Consumables unless DOA
13.5 Limitation of Liability
- Liability capped at amount paid for goods/services.
- No cover for indirect losses (e.g., business interruption).
- Doesn’t exclude liability for death/injury or fraud.
14. Data Protection
- Evo 3D complies with UK GDPR and the Data Protection Act 2018.
- We process your data lawfully and securely.
15. Legal Protections & Limitations
15.1 Retention of Title
Goods remain Evo 3D’s property until fully paid. We may reclaim goods if unpaid.
15.2 Intellectual Property
All rights to designs, docs, and software remain with Evo 3D or licensors.
15.3 Use Restrictions
Goods are for UK/EU use unless agreed. No export/resale without permission.
15.4 Product Substitution
We may substitute goods with equal or better alternatives if needed.
15.5 Storage Fees
£60/week applies if Customer delays delivery by 14+ days or site is unprepared.
15.6 Software/Firmware
Evo 3D isn’t liable for bugs/compatibility unless covered by service contract.
15.7 Termination
We may cancel orders if you breach terms or become insolvent.
15.8 Indemnity
Customer indemnifies Evo 3D against losses from misuse, contract breach, or third-party claims.
16. Force Majeure
We’re not liable for delays caused by events beyond our control (e.g., strikes, natural disasters).
17. Transfer and Subcontracting
- Rights and obligations under this contract may be transferred.
- Evo 3D is responsible for subcontractors we appoint.
18. Governing Law
- Governed by the laws of England and Wales.
- Disputes may be submitted to courts in England, Wales, Scotland, or Northern Ireland as appropriate.
